As a provider of web site hosting and other Internet-related services, LordHost offers its customer (also known as "Subscribers") and their customers and users the means to acquire and disseminate a wealth of public, private, commercial and non-commercial information. LordHost respects that the Internet provides a forum for free and open discussion and dissemination of information. However, when there are competing interests at issue, LordHost reserves the right to take certain preventive or corrective actions. In order to protect these competing interests, LordHost has developed an Acceptable Use Policy ("AUP"), which supplements and explains certain terms of each customer's respective service agreement, and is intended as a guide to the customer's rights and obligations when using LordHost' services. This AUP will be revised from time to time.
One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use it, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that LordHost cannot monitor, verify, warrant or vouch for the accuracy and quality of the information they acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet may be sexually explicit or otherwise offensive. Because LordHost cannot monitor or censor the Internet, and will not attempt to do so, LordHost cannot accept any responsibility for injury to its subscribers resulting from inaccurate, unsuitable, offensive or illegal Internet communications.
When subscribers disseminate information from the Internet, they must keep in mind that LordHost does not review, edit, censor or take responsibility for any information its subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation and other harmful speech. Also, because the information created is carried over LordHost' network and may reach a large number of people, including both subscribers and non-subscribers of LordHost, subscribers' postings to the Internet may affect other subscribers and may affect LordHost' goodwill, business, reputation or operations.
LordHost reserves the right to define what activity counts as abuse. And as such, LordHost reserves the right to suspend and terminate any of its "Subscriber"'s account or services if found to be breaking Acceptable Use Policy and engaging in any activity that, by LordHost standards, constitutes abuse. This subscriber also forfeits any rights to a refund, when they engage in "abuse" activity or any activity that violates our Acceptable use Policy.
If you are suspected of abuse, we reserve the right to initiate a full scan of your files and your content in order to handle the situation properly.
Such abuse activities include, but are not limited to:
A) Any attempts to compromise or actual compromise of a network device belonging to us, our server host, or any other company, individual, or other entity is strictly prohibited. This offense also includes port scanning, IP range scanners and vulnerability scanning.
B) Denial of Service attacks directed at us, or any attempts to launch a Denial of Service attack from our servers are strictly prohibited. All infractions and or suspected infractions will be vigorously investigated and may result in immediate termination of service.
C) Sending unsolicited email, newsgroup postings, chain letters or anything else that could be considered as "spam", is strictly prohibited. The gathering of email addresses to be used for sending unsolicited email on a 3rd party service "harvesting" is also prohibited and may result in termination of service.
D) The hosting of material that infringes on any copyright, trademark and or service mark is strictly prohibited. This also includes the storage and transmission of pirated movies, music, software, ring tones or anything else considered "warez". Any complaint received will be investigated and may result in termination of service.
E) Child pornography, bestiality, hate speech, scam sites, phishing sites and any other material which is considered to be illegal in Canada and/or The United States of America is strictly prohibited.
F) Hosting any software, source code or any other material that is illegal or could be used to commit an illegal act is strictly prohibited. This includes but is not limited to software exploits, exploit source code, hacking tutorials, hacking tools, viruses and trojans, bomb making and similar device tutorials.
G) The use of IRC software, Bit Torrent software, Proxy software, and automated "bots" is strictly prohibited. The use of some forums and any other multiuser chat software which could create a high load on our servers, disrupt other users, and/or attract Denial of Service attacks is also prohibited.
H) Offering image, file, document or data storage and free hosting or email services are strictly prohibited.
"Unlimited" or "Unmetered" Storage or Bandwidth Packages and Fair Use Policy
If your plan features unlimited or unmetered storage or bandwidth, you agree to fair use, and agree not to abuse the resource that is advertised as "Unlimited" with your hosting plan.
We reserve the right to define what constitutes abuse of such resources.
However, keep in mind that concerning bandwidth, we guarantee you will be properly following this policy as long as you do not use more than 500GB of bandwidth per month per "Unlimited Bandwidth" plan.
If you are found to be abusing (excessive consumption of) any server resources that leads to server deterioration or a bad customer experience for our other clients and/or yourself, you will be given a warning.
This could escalate to a temporary or permanent suspension of your services, up to our total discretion.
You forfeit rights to a refund if you are found to be violating the above Fair Use Policy ("FUP").
